When and how often do you need to renew a trademark?

Trademark protection lasts for ten years, and it does not renew automatically; you therefore need to apply to renew within the allowed timeframe to avoid any gap in protection.

To renew easily, there is a 12-month renewal window, which lies on either side of the six months before the expiry date, and the six months after the expiry date

In some cases, you may still be able to renew after this window, but it becomes more complicated, and it ultimately makes the process longer than it needs to be.

The good news is that legal help can assist you in renewal so you don’t miss this all-important deadline.

How to renew your trademark: online or postal applications?

You can renew your trademark online; this is usually the quickest and simplest way.

However, something to keep in mind is that if a trademark expired more than 6 months ago, you may need to renew by post, so keep this in mind.

Postal applications usually take longer to process, so plan ahead if you need to use this route, some things you need to address and ensure are correct include, but aren't limited to:

  • Name and address

  • Classes of goods and services covered

  • Trademark registration number

Accurate details means that you can rest assured you won't have pressing issues with your renewal, plus bear in mind that renewing online is usually the fastest and simplest option.

In order to do this, you will typically need:

  • An email address

  • Trademark registration number

  • Payment method

Again, postal renewal is possible, but it is slower and can delay your protection.

Trademark renewal costs

You must pay a renewal fee to keep your trademark registration active. The current fee is £200 for the first class of goods or services, plus £50 for each extra class.

If your trademark covers several classes, factor these fees into your brand protection planning.

Reviewing your protection at the renewal stage

Renewal is a good time to check if your trademark still gives your business the protection it needs. You should consider things such as whether your brand has evolved since the original application, or if the registered classes still reflect your current business activities

If your business has changed, you may need to update your protection to make sure you are fully covered.
